This website is operated by Basic Barista Aus. Throughout this site, the terms “we”, “us”, and “our” refer to Basic Barista Aus.

Basic Barista Aus provides this website, including all information, tools, and services available on it, to you, the user, on the condition that you accept all of the terms, conditions, policies, and notices set out here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by these Terms of Service (“Terms”), including any additional terms, conditions, and policies referenced here or linked from this page.

These Terms apply to everyone who accesses the site, including browsers, customers, and contributors of content.

Please read these Terms carefully before using our website. By accessing or using any part of the site, you agree to be bound by these Terms. If you do not agree, please do not access the website or use our Services.

We may update these Terms from time to time, see Section 24 (Changes to These Terms) for how we will notify you of material changes.

Our store is hosted by Shopify Inc, who provide the ecommerce platform that allows us to sell our products to you.

Section 1 - Online Store Terms

By agreeing to these Terms, you represent that you are at least the age of majority in your state or territory of residence, or that you have given consent for any minor dependent to use this site.

You must not use our products or services for any illegal or unauthorised purpose, and must not violate any laws in your jurisdiction, including intellectual property and copyright laws.

You must not transmit any worms, viruses, or any code of a destructive nature.

A breach or violation of any of these Terms may result in immediate termination of your access to our Services.

Section 2 - General Conditions

We may refuse service to any person for any lawful reason, including but not limited to suspected fraud, abusive or threatening conduct, pricing or stock errors, safety concerns, or suspected reseller or distributor activity. We will not refuse service on the basis of any attribute protected under Australian anti-discrimination law.

Your content (excluding payment information) may be transferred unencrypted and may involve transmissions over various networks. Payment information is always encrypted during transfer.

You agree not to reproduce, duplicate, copy, sell, resell, or otherwise exploit any portion of the Service, use of the Service, or access to the Service without our express written permission.

The section headings used in these Terms are for convenience only and do not affect their interpretation.

Section 3 - Accuracy, Completeness and Timeliness of Information

We take reasonable care to ensure the information on this site is accurate and current. Nothing in this section affects your statutory rights, including in relation to any error in a product description.

This site may contain historical information which is not current and is provided for reference only.

We reserve the right to modify the content of this site at any time. You are responsible for monitoring changes to our site.

Section 4 - Modifications to the Service and Prices

Prices for our products are subject to change without notice; however, a price change will not affect an order you have already placed and paid for.

All prices displayed on our site are in Australian dollars and are inclusive of GST where applicable, unless stated otherwise. International customers may be responsible for customs duties, import taxes, and other charges imposed by their own country, which are not included in the displayed price, see Section 7 (Shipping, Delivery and Risk of Loss).

We may modify, suspend, or discontinue the Service, or any part of it, at any time. Where a change materially reduces your rights under these Terms, we will take reasonable steps to notify existing customers in advance, such as by a notice on our website or by email where you have an account with us.

Except as required by the Australian Consumer Law, we are not liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service.

Section 5 - Products or Services

Certain products or services may be available exclusively online and may be available in limited quantities. Returns and exchanges are subject to our Return Policy, which forms part of these Terms, please review it before purchasing.

We make reasonable efforts to display our products accurately, including colours and dimensions, but cannot guarantee that your device's display will be completely accurate.

We may limit the sale of our products to any person, household, or region, and may discontinue any product at any time. All descriptions, images, and prices are subject to change without notice.

Nothing in this section limits your rights under the Australian Consumer Law, see Section 17 (Consumer Guarantees and Limitation of Liability).

Section 6 - Accuracy of Billing and Account Information

We reserve the right to refuse or cancel any order for the reasons set out in Section 2, or where we reasonably suspect fraud or error.

We may limit or cancel quantities purchased per person, household, payment method, or address, including across orders placed under the same account or details.

If we change or cancel an order, we will notify you using the email or phone number provided at the time of purchase.

You agree to provide current, complete, and accurate purchase and account information, and to promptly update your details, including email, payment method, and address, to ensure your orders can be completed.

Section 7 - Shipping, Delivery and Risk of Loss

Once your order has been dispatched, risk in the goods passes to you, except where the Australian Consumer Law or other mandatory consumer protection law provides otherwise. If you are a consumer and your order is lost in transit or arrives damaged, you remain entitled to a remedy under the Australian Consumer Law regardless of this clause, please contact us so we can assist.

For international orders, you are responsible for customs duties, import taxes, and any other charges imposed by the destination country. We are not responsible for delays caused by carriers, customs authorities, or circumstances beyond our reasonable control.

Section 8 - Optional Tools

We may give you access to third-party tools that we do not monitor and have no control over. Such tools are provided “as is” and without warranties of any kind, to the extent permitted by law. We are not liable for your use of any optional third-party tool, which is entirely at your own discretion and subject to that third party's own terms.

Section 9 - Payments and Fraud Prevention

Payments are processed securely through Shopify Payments or trusted third-party gateways such as PayPal, Shop Pay, and Afterpay. We do not store your full credit card details. All transactions are subject to fraud screening, and suspicious orders may be delayed or cancelled pending verification.

Section 10 - Third-Party Links

Links on this site may direct you to websites that are not affiliated with us. We do not examine or warrant the content, products, or services of any third party. Use of third-party websites is at your own risk and subject to their own terms and policies.

Section 11 - Intellectual Property

All content on this site, including text, images, graphics, logos, product photography, videos, blog articles, buying guides, comparison tables, brewing and equipment guides, product descriptions, data compilations, design layouts, digital downloads, and all other materials, is the property of Basic Barista Aus or its content licensors, and is protected under the Copyright Act 1968 (Cth) and other applicable Australian and international intellectual property laws.

You may not copy, reproduce, distribute, republish, transmit, display, modify, create derivative works from, upload, or otherwise exploit any part of this site for commercial or public purposes without our express prior written permission. This includes, without limitation:

copying, paraphrasing, or reusing our written content, including blog articles, buying guides, and product descriptions, or imagery on other websites, marketplaces, or digital media;
scraping, data-mining, or harvesting any part of this site, including for AI or machine learning dataset training, analytics, or profiling;
using our branding, trade marks, or visual identity to imply affiliation, endorsement, or partnership; and
republishing, mirroring, embedding, or otherwise displaying our content on social media, ecommerce platforms, or third-party sites without our authorisation.

All trade marks, trade names, and logos on this site remain the property of their respective owners.

We invest significantly in producing original educational and reference content for our customers, including our buying guides and brewing resources, and we actively monitor for unauthorised reproduction or data scraping of this content. Unauthorised use may result in a copyright infringement claim, a takedown request, and recovery of costs and damages under Australian law.

Section 12 - AI and Automated Use Restrictions

You must not use any automated system, software, algorithm, AI model, crawler, bot, or similar technology to access, collect, copy, or analyse any content or data from this site for the purpose of: training or fine-tuning an artificial intelligence model or dataset; generating derivative or synthetic content; or the commercial use, resale, or redistribution of extracted data - whether performed directly, indirectly, manually, or through a third party.

Any breach of this section is a breach of these Terms and, to the extent it involves our copyright material, a potential infringement of the Copyright Act 1968 (Cth), which is our primary basis for enforcement in Australia. Where infringing content is hosted or mirrored overseas, including in the United States, we may also rely on mechanisms such as a DMCA takedown request as a practical, supplementary enforcement tool.

We reserve all rights not expressly granted in this section and may pursue legal action, including injunctive relief and recovery of costs and damages, for unauthorised use of our content.

Section 13 - User Comments, Feedback and Other Submissions

If you submit comments, reviews, photos, or other content to us, including competition entries, you grant us a non-exclusive, royalty-free licence to use, edit, reproduce, publish, and display that content on our site, in our marketing materials, and on our social media channels, for the purpose of promoting Basic Barista and our products. You consent to any act or omission that would otherwise infringe your moral rights in that content, to the extent necessary for us to use it for these purposes.

We are under no obligation to keep your submission confidential, compensate you for it, or respond to it. You agree that your submissions will not violate the rights of any third party and will not be unlawful, defamatory, or obscene. We are not responsible for user-generated content.

Section 14 - Personal Information

Your personal information is handled in accordance with our Privacy Policy. By using our Services, you consent to the collection, use, and disclosure of your personal information as described there, including disclosure to service providers such as Shopify and our payment and marketing partners. We keep our Privacy Policy under regular review to reflect changes in Australian privacy law and will update it as those obligations evolve.

Section 15 - Errors, Inaccuracies and Omissions

Occasionally there may be typographical or informational errors relating to products, pricing, or promotions on our site. We reserve the right to correct any such errors, update information, and cancel affected orders, and will notify you if this affects an order you have placed.

Section 16 - Prohibited Uses

You must not use this site or its content for any unlawful purpose, to infringe any intellectual property or other right, to harass any person, to transmit malware, to collect personal information without consent, or to interfere with the security of the site. We may terminate your use of the site for any prohibited activity.

Section 17 - Consumer Guarantees and Limitation of Liability

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law (Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded. If our goods or services fail to meet a consumer guarantee, you are entitled to a remedy such as repair, replacement, refund, or compensation, as appropriate. For customers in the EU, UK, or other jurisdictions with non-excludable statutory consumer rights, nothing in these Terms limits those rights either.

Subject to those rights, our Service and products are provided on an “as available” basis. We do not guarantee that access to the Service will be uninterrupted, error-free, or completely secure, and, to the extent permitted by law, we are not liable for indirect or consequential loss arising from your use of the Service or our products.

Section 18 - Indemnification

You agree to indemnify and hold harmless Basic Barista Aus, its officers, employees, and affiliates from any claim arising from your breach of these Terms or your violation of any law or third-party right.

Section 19 - Severability

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be severed, and the remaining provisions will continue in full effect.

Section 20 - Termination

These Terms remain in effect until terminated by you or us. You may terminate them at any time by ceasing to use our site.

We may terminate or suspend your access immediately, without notice, where we reasonably believe you have breached these Terms, engaged in fraud, or acted unlawfully. In other circumstances, we will provide reasonable notice where practicable. You will remain liable for any amounts owing up to the date of termination.

Section 21 - Force Majeure

We are not liable for any delay or failure to perform our obligations due to causes beyond our reasonable control, including natural disasters, war, industrial action, shipping disruptions, or government restrictions.

Section 22 - Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Return Policy, constitute the entire agreement between you and us and supersede any prior agreements regarding your use of our Service. Our failure to enforce any provision of these Terms does not waive our right to enforce it later.

Section 23 - Governing Law and Dispute Resolution

These Terms are governed by the laws of Victoria, Australia, and the applicable laws of the Commonwealth of Australia, without affecting any mandatory consumer protection rights you may have under the laws of your country of residence.

Any dispute arising from these Terms will first be addressed through informal negotiation or mediation between the parties before either party commences legal proceedings, which will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

Section 24 - Changes to These Terms

We may update these Terms from time to time. The current version will always be available on this page. Where a change materially reduces your rights, we will take reasonable steps to notify existing customers, such as by a notice on our website or by email. Your continued use of our site after a change takes effect constitutes your acceptance of it.

Section 25 - Contact Information

Questions about these Terms should be sent to us via our Contact Us page.

Section 26 - Allergen Statement

While we take reasonable care with the product information we provide, some coffee products sold on our site may contain or come into contact with allergens such as nuts, soy, or dairy. We do not guarantee that any product is allergen-free. If you have a food allergy or specific dietary requirement, please check product packaging and labelling, contact us before ordering, or consult your healthcare provider.

Section 27 - Shopify Processing of Customer Data

Our store is hosted by Shopify Inc, who collect and process customer information on our behalf to operate the store, including aggregated insights derived from interactions across the Shopify platform. See our Privacy Policy for further detail.
